In no event shall the total liability of Erynvor and its affiliates, officers, directors, employees, agents, partners, and licensors to you exceed the amount paid by you, if any, for accessing or using Erynvor during the twelve months preceding the date of the claim.
This limitation of liability applies whether the alleged liability is based on contract, tort, negligence, strict liability, or any other basis, even if Erynvor has been advised of the possibility of such damages.
These terms and conditions shall be governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law principles. Any dispute arising out of or in connection with these terms and conditions, including any disputes regarding the existence, validity, or termination thereof, shall be resolved by the courts of the Netherlands.
You hereby irrevocably consent to the exclusive jurisdiction and venue of the courts of the Netherlands in all disputes arising out of or relating to the use of Erynvor.
If any provision of these terms and conditions is found to be invalid or unenforceable by a court of competent jurisdiction, such provision shall be severed from the remainder of these terms and conditions, which shall remain in full force and effect.
Erynvor reserves the right to suspend or terminate your access to the service at any time, with or without cause, and with or without notice. Reasons for such termination may include, but are not limited to, violations of these terms and conditions, requests by law enforcement or other government agencies, discontinuance or material modification of the service, or unexpected technical or security issues or problems.
In the event of termination, your right to use the service will immediately cease, and you must cease all use of the service. Erynvor shall not be liable to you or any third party for any termination of your access to the service.

Any dispute, controversy, or claim arising out of or relating to these terms and conditions, or the breach, termination, or invalidity thereof, shall be settled by arbitration administered by the Netherlands Arbitration Institute (NAI) in accordance with its Arbitration Rules.
The arbitral tribunal shall consist of one arbitrator appointed in accordance with the NAI Arbitration Rules. The seat of arbitration shall be Amsterdam, the Netherlands. The language of the arbitration shall be English.
The decision of the arbitral tribunal shall be final and binding upon the parties. Judgment upon the award rendered by the arbitral tribunal may be entered in any court having jurisdiction thereof.
Erynvor reserves the right, at its sole discretion, to modify or replace these terms and conditions at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
By continuing to access or use Erynvor after any revisions become effective, you agree to be bound by the revised terms and conditions. If you do not agree to the new terms and conditions, please stop using the service.
It is your responsibility to review these terms and conditions periodically for changes. Your continued use of the service following the posting of any changes constitutes acceptance of those changes.
