If your account is terminated or suspended for any reason, you are prohibited from registering and creating a new account under your name, a fake or borrowed name, or the name of any third party, even if you may be acting on behalf of the third party. In addition to terminating or suspending your account, we reserve the right to take appropriate legal action, including without limitation pursuing civil, criminal, and injunctive redress. Your use of the services is at your sole risk. The services are provided on an "AS IS" and "AS AVAILABLE" basis. The services are provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
These Terms and Conditions and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the laws of the jurisdiction in which our company is based, without regard to its conflict of law principles. You agree that any dispute arising out of or relating to these terms or your access to or use of the services will be subject to the exclusive jurisdiction of the courts located in that jurisdiction. You hereby irrevocably and unconditionally consent to submit to the exclusive jurisdiction of such courts for any litigation arising out of or relating to the use of the services, waive any objection to the laying of venue of any such litigation in such courts, and agree not to plead or claim in any such court that such litigation brought therein has been brought in an inconvenient forum.
You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to the use of the services or these terms must be filed within one (1) year after such claim or cause of action arose or be forever barred. Our failure to exercise or enforce any right or provision of these terms shall not constitute a waiver of such right or provision. If any provision of these terms is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the other provisions of these terms remain in full force and effect. These terms constitute the entire agreement between you and us regarding the use of the services.
